“The principal issue in this case is whether section 10(1) of the Dartmoor Commons Act 1985 (“the 1985 Act”) confers on the public a right not only to walk or ride a horse on the commons but also to camp there overnight.”
That Friday the 13th was indeed unlucky for the wild camping community, if not wider society. For with the handing down of that judgment, the last remaining rights to wild camp without the permission of the landowner in England and Wales were extinguished.
This case, therefore, represents more than just a landowner seeking to prevent campers using their land without permission. Rather it is a further step in the seemingly inexorable privatisation of the English Countryside for the benefit of the few, to the detriment to the many, and with the full-throated support of the law.
In considering this unfortunate development, I will first set out the background to thecase, then examine the reasoning underpinning the judgment. I will then situate this case in the wider context of public access to the countryside, and ask whether and how this public good can be reconciled with the private property rights of landowners in England and Wales.
Coogan and Philips v News Group Newspapers [2012] EWCA Civ 48 –read judgment
The Court of Appeal today dismissed Mr Glenn Mulcaire’s appeal against an order that he provide information to claimants in the phone hacking litigation. The Court (Lord Judge, Lord Neuberger and Maurice Kay LJ) unanimously upheld the rulings of Mann J and Vos J that, as a result of the operation of section 72 of the Senior Courts Act 1981, Mr Mulcaire was not entitled to rely on his privilege against self-incrimination (“PSI”).
Background
Ms Philips, a former assistant to the publicist Max Clifford and Mr. Coogan each brought proceedings against News Group Newspapers Limited (“NGN”) and Mr Mulcaire for damages for breach of confidence and misuse of private arising out of “phone hacking”. Ms Phillips sought an order that Mr Mulcaire swear an affidavit giving information about the individuals who had instructed him, the interception he was instructed to carry out and other matters. Update (10 October 2025): Kemi Badenoch has confirmed that Conservative Party policy will be to withdraw the UK from the European Convention on Human Rights (ECHR) and to repeal the Human Rights Act if they win the next general election. This was made clear in both her statements ahead of and during the annual Conservative Party Conference in October 2025, following a detailed legal review led by the Shadow Attorney General, Lord Wolfson, which found that remaining in the ECHR would fundamentally obstruct key party policies on immigration, veterans’ rights, prioritising citizens for public services, and reforming sentencing and protest laws.The Conservative Party leader explicitly stated in her conference speech: “We must leave the ECHR and repeal the Human Rights Act. The next Conservative manifesto will contain our commitment to leave. Leaving the Convention is a necessary step.”
Lord Wolfson’s advice was commissioned by the Conservative Party and is known as the Wolfson Report. It is important to note at the outset that, despite its title on the Party website, Lord Wolfson emphasises that this is “neither a policy paper nor a report. It is a legal analysis”, in other words, advice to the leader of the Conservative party. For reasons of economy in the following paragraphs I will refer to this 185 page document as a “report”.
David Wolfson KC is Shadow Attorney General Lord Wolfson of Tredegar, a prominent commercial lawyer and former justice minister. We have heard his views on the role of international law and his differences with government AG Richard Hermer domestic on Law Pod UK earlier this year.
In this paper he sets out an exhaustive examination of the relationship between the European Convention on Human Rights (ECHR) and UK law, specifically focusing on areas where the ECHR constrains the government’s ability to enact domestic policies. This report could be pivotal in shaping the party’s commitment to leave the ECHR, as it concludes that such a move is necessary to fulfil a range of key policy priorities.
For balance, here is the late Conor Gearty’s column in the London Review of Books Unwelcome Remnant – the threat to the Human Rights Act , lamenting judicial avoidance of ECHR solutions to problems and relying on common law or UK legislative measures instead. Gearty cites many examples of this, most notably the Supreme Court’s ruling in the For Women Scotland v The Scottish Ministers which he says “completely ignores the impact of human rights law.”

Overview
The report scrutinises the effect of the ECHR in five core public policy areas: immigration control, prosecution of military veterans, prioritisation of British citizens in social policy, sentencing and protest laws, and economic growth impediments (particularly linked to climate-based challenges to infrastructure projects). Wolfson sets out a detailed legal analysis and a set of evaluative “tests” for national sovereignty, arguing that only by exiting the ECHR and repealing the Human Rights Act can the UK achieve these policy goals unimpeded.

The prospect that genetic information not only affects insurance and employment opportunities is alarming enough. But it has many other implications: it could be used to deny financial backing or loan approval, educational opportunities, sports eligibility, military accession, or adoption eligibility. At the moment, the number of documented cases of discrimination on the basis of genetic test results is small. This is probably due to the relatively few conditions for which there are currently definitive genetic tests, coupled with the expense and difficulty of conducting these tests. But genetic discrimination is a time bomb waiting to be triggered and the implications of whole genome sequencing (WGS) are considered in a very interesting and readable report by the US Presidential Commission for the Study of Bioethical Issues Privacy and Progress in Whole Genome Sequencing.
R (on the application of Guardian News and Media Limited) v City of Westminster Magistrates’ Court [2010] EWHC 3376 – Read judgment
The Guardian newspaper has failed to convince the High Court that it should be able to see key documents in the trial of three men threatened with extradition to the United States on charges of corruption and bribery. The case highlights the finely balanced right to freedom of information.
Since the European Convention of Human Rights came into force in 1953, the scope of the rights contained within it has grown along with the jurisprudence it has given rise to. As times have changed, the Article 8 right to respect for private life has, for example, grown to encompass increased rights for both pre- and post-operative transsexuals. More recently, the Article 10 right to freedom of expression has also been said by the European Court of Human Rights to include a right to access certain kinds of information. The scope of human rights, like many legal definitions, appear to have a metastatic tendency. However, in a recent case involving Art 10 the High Court drew a line in the sand, at least as regards the limited sphere of access to court documents in extradition cases.
Kennedy v. Charity Commission et al, Supreme Court, 26 March 2014 read judgment
In judgments running to 90 pages, the Supreme Court dismissed this appeal by Mr Kennedy, a Times journalist, for access to documents generated by the Charity Commission under the Freedom of Information Act 2000 concerning three inquiries between 2003 and 2005 into the Mariam Appeal. This appeal was George Galloway’s response to the sanctions imposed on Iraq following the first Gulf War, and little Mariam was a leukaemia sufferer. Mr Kennedy’s suspicion, amongst others, was that charitable funds had been used by Galloway for political campaigning.
The Charity Commission had refused the request on the ground that the information was subject to an absolute exemption from disclosure contained in s.32(2) of the FOIA. The Supreme Court (in common with the Court of Appeal) held that the absolute exemption applied and dismissed Mr Kennedy’s request. But the result was a little closer in the SC, with two judges dissenting, essentially on Article 10 grounds.
Sugar (Deceased) (Represented by Fiona Paveley) (Appellant) v British Broadcasting Corporation (Respondent) [2012] UKSC 4 – Read judgment / press summary
The Supreme Court has ruled unanimously that an internal BBC report into its coverage of the Israeli Palestinian conflict was “information held for the purposes of journalism, art or literature” and therefore need not be released to the public under the Freedom of Information Act (FOIA).
Four of the justices were of the view that even if information is held only partly for the purposes of journalism, art or literature, it is outside the scope of the FOIA. Lord Wilson however, was of the opinion that if information is held predominantly for the purposes of journalism, art or literature, it is outside the scope of FOIA and that the Balen Report was held predominantly for those purposes. The BBC will be relieved that the “partly” view prevailed, as the “predominately” test might in practice have brought a lot of internal documents within the scope of the FOIA.
The “Balen Report” was commissioned by the BBC in 2004 by a senior broadcast journalist, Michael Balen. It was commissioned following allegations of bias in the coverage. Mr Sugar, a solicitor, applied to see the report under the Freedom of Information Act 2000. The BBC argued that the report was “information held for the purposes of journalism, art or literature” and therefore fell outside of the Act under the terms of section 7 of Schedule 1 to the Act.

One of the lasting impacts of the COVID-19 pandemic upon the world of work is likely to be a move away from the traditional workplace. In some sectors, such as academia, IT, and administration, remote work or home working is an established working pattern, although a rare one given national statistics from 2019 which indicated only 5% of the workforce worked mainly from home. The need to prevent the spread of the coronavirus through contact in the workplace precipitated a rapid and widespread move to homeworking. In an ONS survey in early May, 44% of adults surveyed were working from home. As some businesses begin to transition back into their previous working patterns, several high-profile companies have announced that they will not expect their staff to return to the workplace and will support homeworking as a permanent option in the future.
Voyias v Information Commissioner and the London Borough of Camden EA/2011/0007 – Read Judgment
The First Tier Tribunal has overturned a decision of the Information Commissioner and ordered Camden Council to provide information about empty properties in the borough to a former member of the Advisory Service for Squatters.
When one thinks of the term “human rights”, the first example that springs to mind is likely to be the right to life, or the right not to be tortured or enslaved – fundamental guarantees that protect the basic dignity of our human condition. Yet human rights are also intended to serve the core goal of preserving and enhancing the strength and rigour of democratic and pluralistic societies, and so the European Convention of Human Rights (EHCR) also contains provisions guarding against discrimination, and protecting freedom of religion and expression.
Abortion in Northern Ireland has had a fraught and frequently distressing history. Until 2019 when the UK Parliament reformed the law, the jurisdiction had the most restrictive approach to abortion in the UK. But even this reform has not reformed the reality, either for those seeking abortion services or information and counselling on such services or for those who work at providers of such services lawfully. I have previously written about the situation as it stood in March 2021, and the reality has changed little since then, with two notable exceptions. In March 2022, the Northern Ireland Assembly passed the Abortion Services (Safe Access Zones) Bill (Northern Ireland) (‘SAZ Bill’) to create buffer zones around lawful abortion providers, in an attempt to criminalise the harassment and intimidation of people who seek or work in such places. On 2 December 2022, tired of the glacial pace and political controversy in commissioning abortion services, the Secretary of State for Northern Ireland moved to commission such services himself. In the interim, the Attorney General for Northern Ireland (‘AGNI’) referred the SAZ Bill to the UK Supreme Court to determine whether it was lawful.
But the SAZ Reference also drew another ECHR issue to the Court’s attention: the assessment of proportionality and reasonable excuse defences in criminal trials involving protests. The main points here were the consideration of the Court’s previous judgment in Ziegler and the judgment of the Divisional Court (England and Wales) in Cuciurean. Unusually for a devolution reference, therefore, the Supreme Court sat as a panel of seven Justices. The SAZ Reference judgment was unanimous and authored by Lord Reed.
Whilst the Special Rapporteur’s conclusions are nuanced in respect of blocking sites or providing limited access, he is clear that restricting access completely will always be a breach of article 19 of the International Covenant on Civil and Political Rights, the right to freedom of expression.
But not everyone agrees with the United Nations’ conclusion. Vinton Cerf, a so-called “father of the internet” and a Vice-President at Google, argued in a New York Times editorial that internet access is not a human right:

This week, the debate about extradition rages on following the Strasbourg Court’s decision in the Abu Hamza case,which raises a number of interesting legal and political questions. Also in the news this week, the issue of access to information has arisen in a variety of forms. And the flagship event of the UK’s chairmanship of the Council of Europe is about to begin in Brighton, with the future of the European Court of Human Rights at stake.
Brighton Conference begins
The Brighton Conference on European Court of Human Rights reform, due to take place on 18-20 April, begins on Wednesday. As noted by the ECHR blog, its program is now available online here, although it is of limited interest given that it sheds little light on what will be discussed. Meanwhile, a group of 11 Non Governmental Organisations have released a joint statement welcoming positive reforms of the Court but urging “all delegations to the negotiations to refrain from endorsing measures which would amend the Convention so as to codify, or seek to prioritise, the principles of subsidiarity and the margin of appreciation or to add new admissibility requirements.”
Litigation relating to information rights can sometimes seem very dry and obscure, entailing lengthy analysis of the merits of public authorities disclosing or withholding information which is highly specialised or obtuse, and of little real interest to the general population. But this case – the case of the “Black Spider Letters” – really is a fascinating one, involving an examination not just of the legislative provisions relating to the disclosure of information, but also a consideration of the existence and extent of constitutional conventions pertaining to the role of the monarchy in government. At the same time, it has the potential to generate such controversy as to make for perfect tabloid fodder. It has been the subject of international news coverage. And it’s not over yet.
It all stems from a request for information made under the Freedom of Information Act 2000 (“the Act”) and the Environmental Information Regulations 2004 (“the Regulations”) by a Guardian journalist, Mr Rob Evans. In April 2005 he wrote to seven Government Departments, and asked for a list of correspondence between Prince Charles and the ministers for those Departments between 1 September 2004 and 1 April 2005, as well as copies of each piece of correspondence. Many of the Departments initially relied on exemptions contained in the Act in order to refuse to confirm or deny whether or not they held such information. Ultimately however, all the Departments admitted that such correspondence did exist, but they refused to disclose it.
C-601/15JN (in French only) offers important insights into the detention of asylum seekers. It also somewhat of a double bill, involving not one but two sets of European Human Rights.
In this post I will set out the facts, give a quick refresher of the relationship between the European Convention on Human Rights (ECHR) and the Charter of Fundamental Rights of the European Union (Charter). I will conclude with an overview of the decision itself.
The decision contains a number of important elements, but the one I would like to focus on is the “fit” between the ECHR and the Charter. This manifests itself on two levels. The first is the abstract relationship between the ECHR and the Charter (see Marina Wheeler’s recent post on this: A Charter too Far). This is quite straightforward (see below). The more interesting part is the relation between the different ways the ECHR and the Charter protect from unlawful detention. As shall be seen, the former lists narrow criteria for the lawfulness of detention, whereas the second effectively provides a broad protection against unlawful detention. Reconciling the two was at the heart of JN.
