Abu Hamza, Babar Ahmad, Syed Talha Ahsan, Adel Abdul Bary and Khaled al-Fawwaz have lost their High Court Judicial Review challenges to their extradition to the United States to face terrorism related charges. The court refused permission to apply for Judicial Review.

Two weeks ago the European Court of Human Rights refused the men’s requests to refer their extradition appeal to its Grand Chamber for another hearing. This meant that their case, which was decided in the Government’s favour in April (see our post) became final and there were in theory no remaining barriers to their extradition to the United States to face terrorism charges [Update, 7.10.12 – they are already in the United States, so no more legal shenanigans on these shores].

The men each brought different judicial review claims as a final challenge to their extradition, and those claims have – quite rightly – been dealt with rapidly by the High Court, which rejected the claims outright. As the court’s summary says, these proceedings are “the latest, and if we refuse permission, the last, in a lengthy process of appeals and applications that has continued for some eight years in the case of three and 14 years in the case of two.”

When dealt with at an oral hearing, refusals by the court of permission to apply for Judicial Review are not appealable. So pending any legal shenanigans (I can’t think of anything more they can do but as Julian Assange has taught us all, anything is possible), the (this time really) final barrier to extradition looks to have been removed.

Aarhus breaches all round?

On 6 April 2011, the European Commission announced that it has decided to refer the UK Government to the Court of Justice of the European Communities under Article 258 TFEU, for failing to provide affordable access to justice in environmental cases.

This blog has previously charted some of the twists and turns in the process of showing that environmental challenges are currently “prohibitively expensive” within the meaning of Article 9(4) of the Aarhus Convention – not the least of which was a complaint to the Aarhus Compliance Committee which was upheld by that Committee in October 2010. And the underlying concern is the state of the costs rules under which a claimant may be ordered to pay tens of thousands of pounds of costs if he loses, despite the developing case law on Protective Costs Orders designed to mitigate this.

Terror suspects cannot be deported to Pakistan in case of ill-treatment

Two men suspected of attempting to mount a mass casualty attack can stay in the UK because they risked ill treatment if they were to be sent back to Pakistan. Rosalind English examines whether the extra territoriality reach of Article 3 makes a mockery of the core protections provided by European Convention on Human Rights.

Risk of torture

The alleged operatives appealed against deportation orders/refusals of re-entry on the grounds that they risked ill treatment contrary to Article 3 of the European Convention on Human Rights at the hands of the Pakistani security services. Appeals against deportation were upheld because the reassurances as to the safety of their return was based on evidence that could not be disclosed in open court.

Reporting restrictions and the James Bulger murder – David Burrows

In February 1993, two-year-old James Bulger was abducted, tortured and then murdered by two 10-year-olds, Jon Venables (JV) and Robert Thompson. As Sir Andrew McFarlane P says in the opening words of Venables & Anor v News Group Papers Ltd & Ors [2019] EWHC 494 (Fam) (4 March 2019): ‘The family of young James Bulger were and are deserving of the greatest sympathy as the indirect victims of this most horrific crime.’ It was James’s father and his uncle who brought the question of publicity – or not – for JV back to court.

Their application was to vary a ‘confidentiality’ injunction. The application was made on the basis – said the applicants – that JV’s name and image are now freely available should any member of the public undertake an Internet search. Details of his identity, and locations with which he has been connected in the past, have therefore become ‘common knowledge’.

In the News:

In the matter of the person previously known as Jon Venables, Application by Ralph Stephen Bulger and James Patrick Bulger: Sir James Munby, sitting in the High Court, rejected a legal challenge to release the new identity of one of James Bulger’s killers.

Dame Elizabeth Butler-Sloss issued an injunction in 2001 conferring lifelong anonymity on Bulger’s killers. A number of Bulger’s relatives subsequently issued an application seeking to vary the injunction, though Bulger’s mother was not a party to it.

The application was considered by Edis J earlier this year, who made an order that it be considered by the President of the Family Division at the first available opportunity. The application requested that the court “consider that over 17 years on and with serious offending the experiment of ‘anonymising’ Jon Venables has not worked”. The application was made in light of child sex offences committed by Venables since 2001.

However, the bundle prepared for the hearing by the applicants did not comply with the relevant Practice Direction’s mandatory requirements. In particular, the applicants did not outline how the injunction should be varied or discharged. Compliance, the court held, was important to achieve the aims of bringing down waiting times and delays in hearing cases. Sir James Munby expressed regret that the Practice Direction was still not being adhered to 18 years after it was first issued. Secondly, a witness statement did not comply with Family Procedure Rule 25.4(2). If the applicants wished to reply on expert evidence, they should have made an application to do so. The court recognised that the application had been prepared in haste but noted that deficiencies remained three months later.

In light of this, counsel for Mr Venables and the Attorney General were severely disadvantaged in their understanding of the case. An order was therefore made to remedy the deficiencies in the relatives’ application.

“Civil rights” in Strasbourg: development or dithering?

In a very short judgment about asset freezing orders the Court of Appeal has made some tart observations about the inchoate nature of Strasbourg’s rulings. These will no doubt have a certain resonance given the current fervid discussion about the competence of that court.

It was all in the context of an apparently esoteric argument about the precise nature of judicial review proceedings and whether or not they are covered by the fair trial guarantees of Article 6. The respondents’ names been placed on a United Nations list of persons believed to be associated with terrorism. The purpose and effect of listing was to freeze the listed person’s assets, to place the release of any funds at the discretion of the executive, and thereby to make him a prisoner of the state.

Government may weigh rights against national security without courts’ interference

The exclusion of a dissident Iranian from the UK, on grounds that her presence would have a damaging impact on our interests in relation to Iran, has been upheld by the Supreme Court. (My post on the Court of Appeal’s ruling is here).

At the heart of the case lies the question of institutional competence of the executive to determine the balance between the relative significance of national security and freedom of speech. The exclusion order was imposed and maintained because the Home Office is is concerned with the actual consequences of Mrs Rajavi’s admission, not with the democratic credentials of those responsible for bringing them about. The decision-maker is not required by the Convention or anything else to ignore or downplay real risks to national security where they originate from people acting for motives which are contrary to the values of this country.

9/11 ten years on

It is ten years since the terror attacks of 11 September 2001. Like many people, I have been thinking back to where I was on that day.

Bizarrely, given what followed, I spent 11 September 2001 only a few miles away from the United States military base in Guantanamo Bay. I was travelling through Cuba with friends, and we had reached the Eastern tip of the island, the seaside village of Baracoa. We had even visited Guantanamo Bay’s entrance the previous day; it was a tourist attraction which the Lonely Planet guide billed as the place where you could find Cuba’s only MacDonalds.

Supreme Court endorses judicial review over other remedies – in some cases

Following our recent Law Pod UK episode on judicial review, this case contains some useful guidelines to the differences between the kinds of remedy available via judicial review versus statutory appeal, private civil actions, private prosecutions and other avenues for compensation.

It involved an application for judicial review of decision-making by the regulator of landfill maintenance, where the regulator argued that the claimant had an adequate alternative remedy such that judicial review should be refused.

The applicant, Noeleen McAleenon, had claimed that the regulator had not taken appropriate action to prevent harmful chemical gases and noxious smells escaping from a neighbouring landfill site. But the public bodies maintained that judicial review should be refused because Ms McAleenon had adequate alternative remedies, in that she could herself launch a private prosecution against the owner of the site: Section 70 of the Clean Neighbourhoods and Environment Act (Northern Ireland) 2011 (“the 2011 Act”) provides that a person aggrieved by the existence of a statutory nuisance may make a complaint to the magistrates’ court for an order requiring abatement of the nuisance and prohibiting its recurrence and the imposition of a fine.) Alternatively, the defendants said, she could bring a nuisance claim against them in private law.

The first instance judge dismissed the alternative remedies defence. He observed (para 92) that the case concerned the public law issues of regulation and enforcement, whereas any private prosecution in the magistrates’ court under section 70 would centre on the issue of whether a nuisance had been caused. Whilst there is of course an overlap between the two questions, the two kinds of litigation have quite different purposes:

“a member of the public with sufficient interest is entitled to hold regulators to account by pursuing any public law wrongdoing. It would be an unfortunate and unattractive position if a regulator could effectively be immune from suit in this sphere by reference to alternative proceedings in the magistrates’ court”.

Care system failures breach children’s human rights

The poor quality of provision for children in care was much in the headlines last week. A highly critical report by the Deputy Children’s Commissioner, which found children in many privately run care homes were at high risk of suffering violent or sexual abuse, was followed by the Government’s announcement of plans to speed up the adoption process and allow families who wish to adopt children to foster them first.

The problems of the current system and the effect these have on the lives of individual children was also vividly highlighted in a tragic case in which the High Court held that a series of failures by a local authority constituted a breach of two young boys’ rights under Articles 3 (protection from inhuman and degrading treatment), 6 (fair trial rights) and 8 (family and private life rights).

The very distressing story of the boys’ lives to date is set out in considerable detail at paragraphs 18-102 of Mr Justice Jackson (Jackson J)’s judgment. However, the brief facts are as follows. A and S are brothers who were first taken into care in 1998, aged just 3 and 6 months’ old, after their mother abandoned them. The local authority initially placed them with their aunt, but she was a single woman with six children of her own and could not cope.

Spiritual Injury voids Mayor’s Election

The Guardian has reported that Lutfur Rahman, the former directly elected mayor of Tower Hamlets is “exploring the possibility” of judicially reviewing the judgment of the Election Commissioner, Richard Mawrey QC declaring his 2014 election void and barring him from standing in the mandated repeat of the poll.

The only surprise is the qualified nature of the statement as his website had already announced his decision to appeal two days before. This site also directs readers to a petition which describes the case as, “a politically-charged stitch up and an anti-democratic coup.” The Guardian quotes the Head of the Tower Hamlets branch of UNITE as describing the judgment as “an undemocratic assault on the people of Tower Hamlets” which was both “racist” and “Islamophobic”.

The Round-Up – chemical weapons and Supreme Court judgments

Chemical attacks in the northern Syrian province of Idlib have left at least 80 dead and 100 more injured. It has been reported that in a raid last Tuesday morning Syrian government planes exposed countless civilians in the town of Khan Sheikhun to toxic gas, suspected to be sarin. While Syrian President Bashar al-Assad denies claims that he is the author of these attacks, outrage has erupted across the world, which culminated in US President Donald Trump commencing airstrikes on Syria.

The Weekly Round-up: An ‘Attack’ on Human Rights and Two Failed Judicial Reviews

In the news

This was a busy week. It saw the beginning of a nationwide vaccine roll-out and protracted negotiations in Brussels to stave off a no-deal Brexit (which remains a ‘high probability’ according to the Prime Minister). It also saw the Government announce the appointment of retired Court of Appeal judge Sir Peter Gross to lead the review of the application of the Human Rights Act 1998 in the UK Courts. This review will look at the relationship between UK courts and the European Court of Human Rights in Strasbourg; the impact of the Human Rights Act on the relationship between judiciary, executive, and Parliament; and the application of the Human Rights Act to actions taken outside the UK.

Moving to Brexit, the House of Lords voted on Monday to approve a Labour amendment to the Government’s Trade Bill. The amendment requires that Ministers undertake a human rights impact assessment for any trade deal, and must revoke an agreement in any case where potential genocide is found in a UK High Court ruling. The measure has been proposed in response to allegations that China is committing genocide against the Uighur Muslims in Xinjiang province.

Justice cuts to be 50% more than first thought

Updated x 2full details of review below |  The much-heralded Ministry of Justice budget cuts will be announced shortly as part of the government spending review. Previously, it had been reported that the department’s budget would be cut by around 20%, or £2bn (see our post). However, over the weekend the Observer reported that the cut would be much larger, running to £3bn – around 30% of the total budget – which represents a 50% increase on the original figure.

The justice minister Ken Clarke is believed to have had to take an extra hit “after the defence secretary, Liam Fox, and Michael Gove at education won more generous agreements than previously expected“.

A bluffer’s guide to human rights courts

Back to basics, then, as the new academic year starts. Which courts decide human rights cases, when, and by what rules?

Well, the easy one is domestic courts. They decide whether a public authority has acted or omitted to act unlawfully under the Human Rights Act.

If the act is a decision about housing or immigration status or prisoners’ rights, the courts can quash it, and so tell the decision-maker either to decide it again or if there is only one lawful answer, tell the decision-maker what decision to take. If it was a past course of conduct (unlawful detention, intrusion into privacy, unacceptable pollution), they may award damages for human rights breaches. If the domestic law is itself unlawful, and cannot be interpreted HR-compliantly, the domestic courts can make a declaration of incompatibility under s.4 of HRA – it does the claimant no good in respect of his claim, though it throws a huge gauntlet down to Parliament to do something about the non-compliant law. And in the criminal courts, the obvious sanction is to dismiss the prosecution for some abuse of process involving the defendant’s human rights.
