Chemical attacks in the northern Syrian province of Idlib have left at least 80 dead and 100 more injured. It has been reported that in a raid last Tuesday morning Syrian government planes exposed countless civilians in the town of Khan Sheikhun to toxic gas, suspected to be sarin. While Syrian President Bashar al-Assad denies claims that he is the author of these attacks, outrage has erupted across the world, which culminated in US President Donald Trump commencing airstrikes on Syria.
The Ministry of Justice has published its annual report to the Joint Committee on Human Rights on the Government response to human rights judgments 2011–12. By signing up to the European Convention on Human Rights, the UK has committed to “abide by” judgments of the court. This commitment is monitored by the Council of Europe’s Committee of Ministers.
The report presents a snapshot of the current state of play in relation to the European Court of Human Rights, makes for very interesting reading (trust me!). Here are some tidbits:
There were 28 judgments involving the UK from 1 August 2011 to 31 July 2012, nine of which the UK lost (UK loses 3 out of 4 cases, anyone?). See the handy table at pages 12-13.
The UK currently has 24 cases before the Committee of Ministers, which means that they have not been implemented.
The UK paid out €454,457 [this originally and wrongly said £] in damages for human rights violations (known as ‘just satisfaction’) in 2011, compared to €371,160 in 2010 (p.58). Fear of this figure ending up in the Daily Mail may be the reason that it is on the last page.

As with all internet sites, there are no prizes for guessing why Should people with low IQs be banned from sex? comes out with almost the highest number of hits, and no doubt some of the visitors to that page would have gone away disappointed, but we promise it is a fine piece on a very interesting issue. And the high score achieved by our post Brititsh airways strike and human rights – the union strikes back has less to do with law than travellers’ anxieties about their scheduled flights.

The publication on Thursday of the long awaited report by Sir Robert Owen into the circumstances of the death of Alexander Litivenko from polonium poisoning on 23 November 2006 has (unsurprisingly) resulted in bitter criticism by the Russian Government of the Inquiry’s conclusions that the poisoning was probably directed by the Russian Federal Security Service, and probably approved by President Putin. The report is long (246 pages not including Appendices), but in page after page of readable and measured prose Sir Robert Owen tells the extraordinary story of Alexander Litvinenko’s death and the subsequent 9 year investigation into it. It is fashionable at the moment to speak about ‘evidence-based’ policy. The concept has been imported from the sciences by advocates such as Dr Ben Goldacre. In short, policies should be based on empirical evidence, statistics and perhaps even randomised trials. Very sensible. So sensible, you would hope that Government has been doing it anyway.

Commentary on the Leveson report is again dominating the blogosphere this week – and once again, there is some discussion on whether the UK should maintain a relationship with Strasbourg. Gay marriage is also back in the news. However, we also have some “new” news, covering such diverse topics as homosexuality in the Channel Islands, “indie lawyers” and legal aid. A quick reminder: tomorrow (Monday 10 December) is Human Rights Day. We will be hosting a guest post which you can read in the morning.

Remembering 9/11, 10 years on
Last week the Law and Lawyers blog posted a retrospective of 9/11 and the consequent events of legal significance that impacted, and continue to impact, on the UK. The Human Rights in Ireland blog discussed the Terrorism Prevention and Investigation Measures legislation in the UK, whilst Adam Wagner took the unusual step of sharing his personal reflections on 9/11. Dapo Akande links his post on the EJIL Talk blog to an interview in a BBC Radio programme where he discussed, amongst other things, whether the Geneva Conventions apply to the so called “war on terror”.
Department of Health v IC, Healey and Cecil(EA/2011/0286 & EA/2011/0287) – Read Decision
In a recent post, Panopticon brought you, hot-off-the-press, the Tribunal’s decision in the much-publicised case involving publication, under Freedom of Information Law, of the NHS Risk Register. Somewhat less hot-off-the-press are my observations. This is a very important decision, both for its engagement with the legislative process and for its analysis of the public interest with respect to section 35(1)(a) of Freedom of Information Act 2000 (formulation or development of government policy) – particularly the “chilling effect” argument. At the outset, it is important to be clear about what was being requested and when.
Risk registers in general
The DOH prepared two “risk registers” documenting the risks associated with implementing the “far-reaching and highly controversial” NHS reforms under what was then the Health and Social Care Bill. The Tribunal heard that risk registers are used widely across government for project planning. They provide snapshots (rather than detailed discussions) combining the probability of and outcomes from any given risk associated with the proposed reform; risks are then classified in red, amber or green terms. According to Lord Gus O’Donnell, who gave evidence in support of the DOH’s case, risk registers are the most important tool used across government to formulate and develop policy for risk management in advising ministers. John Healey MP, one of the requesters in this case, said that he was a minister for ten years and was never shown such a register.
Today we will see the beginning of the end of the passage of the Justice and Security Bill through Parliament: the process commonly known as parliamentary “ping-pong”.
The notion of a Bill being swatted back and forth across the Palace of Westminster is at its most accurate in the case of controversial legislation such as the “secret courts” Bill (see previous discussions of these controversies).
With allegations that ministers may have misled parliamentarians on the scope of their prized Bill, the picture of political game-playing might be apt. However, this is the last chance for parliament to consider the government’s case for the expansion of “closed material procedures” (CMP), where a party to proceedings and his lawyers (together with the public and the press) are excluded – and his interests represented by a publicly appointed security vetted lawyer, known as a Special Advocate. An analogy more serious than Boris’ “wiff-waff” might be needed for tonight’s debate. Some commentators have suggested the Lords will play “ping-pong with grenades”.
On 11 August, a piece from Professor Richard Ekins KC (Hon) set out a case for the UK denouncing the European Convention on Human Rights (ECHR) and leaving the treaty system altogether. One of the main arguments in favour of this is that it would ‘restore Parliament’s freedom, on behalf of the British people, to decide what our laws should be’. This marks one of the more recent such calls, amid a growing chorus of Ministers in the UK Government and Conservative Party MPs to leave the ECHR. Also, it should be noted that we have been here before. The constitutional aspects of such a move aside, there are particular reasons why it would impact Northern Ireland. While Northern Ireland does not feature in Professor Ekins’ 11 August piece, he has previously written about the interaction between the ECHR and the Good Friday Agreement 1998 (GFA), which underpins the modern devolution settlement in Northern Ireland and which brought an end to a brutal and deadly conflict. This interaction is the subject of this post.
The parliamentary Joint Committee on Human Rights this week published a report of its inquiry into whether the UK should ratify Protocol 15 of the European Convention on Human Rights. As the report states, Protocol 15 is the culmination of the UK Government’s contribution to the process of reform of the European Court of Human Rights, which was the UK’s top priority during its Chairmanship of the inter-governmental arm of the Council of Europe, the Committee of Ministers, in the first half of 2012.
The JCHR identifies as the most significant aspect of Protocol 15 the addition to the Preamble of the Convention of an express reference to the principle of ‘subsidiarity’ and the doctrine of ‘the margin of appreciation’. The Committee welcomes this amendment and recommends that the UK should ratify the Protocol – but only after it has been debated in both Houses as a means of raising members’ awareness of its significance.
This post focuses on the implications of Protocol 15 for the UK’s increasingly turbulent relationship with the Convention system, and for the wider debate about the purported ‘democratic deficit’ created by supranational judicial supervision of domestic democratically-accountable authority.

In recent weeks, the Prime Minister’s cabinet reshuffle has sparked fears of human rights reform, while Parliament has come under fire for the speed at which it passed emergency legislation on data retention. In other news, the residence test for legal aid faced legal challenges, while Lindsay Sandiford lost her final appeal in the UK courts in her attempt to stop her execution in Indonesia.
In a couple of weeks’ time, the government’s relationship with the Council of Europe will reach something of a turning point.
If the UK is going to comply with its international treaty obligations, ministers will have to “bring forward legislative proposals” by 22 November that will end what the European court of human rights calls the “general, automatic and indiscriminate disenfranchisement of all serving prisoners”.
That’s all the government has to do. There’s no need to give all or even most prisoners the vote. Parliament doesn’t even have to approve the proposals, although its failure to do so would lead to further challenges in due course.
But the prime minister painted himself into a corner last month. It’s true he offered to have “another vote in parliament on another resolution”. But a resolution is not the same as a bill. And David Cameron said, in terms: “Prisoners are not getting the vote under this government.”
The UK has seen an increasingly falling rate in arrests and prosecutions for cannabis possession over recent years, as police forces no longer see the point in enforcement. The Liberal Democrats have campaigned for its legalisation since 2016, and the first medically-prescribed cannabis was permitted in the UK in 2018. However, crucial NHS cannabis-based medicines for epilepsy remained prohibitively difficult to access for another year, with the majority of self-reported ‘medicinal’ users still turning to the black market. With growing numbers of US states, alongside Canada and South Africa decriminalising recreational use over the past three years, some UK MPs believe that cannabis legalisation will occur in the UK within five to ten years.
President Putin has ordered his troops in Ukraine to cease fire for 36 hours over Orthodox Christmas and has urged Ukrainian forces to do the same. However, the move was rejected by Kyiv, and the US state department, as a “cynical trap” and propaganda move. Putin announced the truce, to begin at noon 6 January 2023, after a call by Patriarch Kirill, leader of the Russian Orthodox Church.
Ministers announced legislation that looks to enforce “minimum service levels” in six sectors, including the health service, rail, education, fire and border security. Unions that refuse to do so will face injunctions and could be sued for damages. Employers will be able to sue unions, and dismiss union members who are told to work under the minimum service requirement but refuse to do so. Prime minister Rishi Sunak, however, vetoed more far-reaching measures that would have increased the threshold for strike ballots, doubled the notice for industrial action from two weeks to a month, and banned ambulance workers from striking.
The British Medical Association have informed the government that junior doctors will strike for 72 hours in March if the action is supported in a ballot opening next week. Doctors would not provide emergency care during the strike. The union, which has 45,000 junior doctor members, wants their real-terms pay restored to 2008 levels: a 26.1 per cent increase. The scale of the strike proposed by the BMA is larger than those to be held by nurses and ambulance staff, and will inflame tensions between the unions and the government. The Royal College of Nursing strikes are for 12 hours at a time, and the ambulance unions are holding 24-hour strikes.
