Five things we learned from Cameron’s human rights announcement

9e422861-3131-40b3-a703-62426b2d1c9a-620x372There was some surprise at the lack of detail over human rights in Justice Secretary Chris Grayling and Home Secretary Theresa May’s speeches yesterday. Now, David Cameron has revealed all. Or at least, he has revealed some. Here is what we learned.

1. The Conservative Party will not be leaving the European Convention on Human Rights if it obtains a majority in 2015-2020.

This is the really important bit, as everyone knew the longstanding Tory policy of repealing the Human Rights Act and replacing it with a Bill of Rights (see below) would be maintained. There has been plenty of noise from the Eurosceptic right of the party in relation to the ECHR – both Grayling and May have consistently said leaving was a possibility. But surely now it is not. Or at least, if it intends to do so it would be very odd for that major policy not to have been mentioned at the Conference.

2. Saner heads have prevailed over the ECHR

Welcome back to the UK Human Rights Roundup, your weekly bulletin of human rights news. The full list of links can be found here. You can also find our table of human rights cases here and previous roundups here.

This week’s human rights news was dominated by the man who has become the Home Secretary’s bête noire, Abu Qatada.  Elsewhere the UK’s relationship with the Strasbourg Court was addressed by Jack Straw and the Court’s recently-retired President, whilst the Court, itself, criticised the UK’s policy on criminal records data retention.  Meanwhile, in speeches two Court of Appeal judges have made expressed views on human rights and the principle of proportionality.

Polluter Pays Principle: in Tobago, in the EU/UK, and in UK post-Brexit

A vignette of where

(1) Trinidad and Tobago is,

(2) the EU/UK is,

(3) where Michael Gove may wish us to be post-Brexit,

on the Polluter Pays Principle (PPP), a key environmental principle.

As we shall see, in legal terms, the expansiveness of (1) and (2) contrasts with the potential parsimony of (3).

Now (3) may be better than nothing, as per the European Union (Withdrawal) Bill, i.e, no enforceable environmental principles at all. But that does not mean we should not aspire for more. After all, as we shall see, the PPP is hardly a racy new entrant into environmental law.

R (Associated Newspapers) v Lord Justice Leveson: Challenge to Anonymity Ruling Dismissed

On Friday 20 January 2012 the Administrative Court dismissed the second application for judicial review of the Leveson Inquiry.   The Court dismissed an application by Associated Newspapers (supported by the Daily Telegraph) to quash the decision of the Chairman, Lord Justice Leveson. decision to admit evidence from journalists who wish to remain anonymous on the ground that they fear career blight if they identify themselves.  

Lord Justice Toulson commented “that the issues being investigated by the Inquiry affect the population as a whole. I would be very reluctant to place any fetter on the Chairman pursuing his terms of reference as widely and deeply as he considers necessary”.

Will publishing photos of alleged rioters infringe their human rights?

In the wake of the recent violence in cities across England, the police have been releasing photographs of individuals in an appeal to the public for assistance in identifying them and bringing them to justice.

As the crisis has developed, politicians and police spokespeople have professed a strong intention to ensure that all the rioters and looters face the consequences of their actions. As of this morning, in London alone 888 people have been arrested and 371 people have been charged with offences relating to their involvement in the riots, and courts in London, Manchester and Solihull have remained open through the night in order to process these cases as swiftly as possible. Yet with the number of people involved likely to be in the thousands, there are many more who remain unidentified.

Refusal to grant legal aid to mother for inquest into son’s death was unlawful

It would seem that legal aid is the topic of the day. Mr Justice Hickinbottom in the High Court has quashed the decision of the Legal Services Commission (LSC) not to grant an applicant for Judicial Review, Mrs Humberson, legal aid for representation at the inquest enquiring into the death of her son, Dante Lee Kamara. The judge took the opportunity set out five criteria which the LSC should apply when considering future applications (listed after the page break below).

Dante died in hospital on 1 July 2008 after an asthma attack. He was aged 10. The judge criticised the LSC’s decision not to grant funding to his mother, saying:

95. I regard the failure of the Commission to take into account the true nature and seriousness of the allegations Miss Humberstone faces at the inquest as a particularly serious defect in the decision making process: one reason why this case is unusual and essentially exceptional is because of the serious allegations Miss Humberstone faces, at the instigation of the agents of state who, she suspects, may have caused or contributed to her son’s death. This case does not open up any floodgate. I do not demur from the view in the Lord Chancellor’s Guidance, which itself reflects comments in Khan, that “in the overwhelming majority of cases the coroner would be able to conduct an effective judicial investigation himself without there being any need for the family of the deceased to be represented” (paragraph 27.4.7 of the Funding Code, quoted at paragraph 37 above). Given the nature of an inquest, and the specialist nature of coroners, that must be so.

Article 2(1) of the European Convention on Human Rights provides: “Everyone’s right to life shall be protected by law“. That primary obligation includes not only a duty on the state not to take life, but also a duty on the agents of the state to take appropriate legislative and administrative steps to protect individuals from threats to life when in their care. This also encompasses a duty, in some circumstances, to investigate a death, and if necessary, provide funding so that the investigation, including an inquest, functions properly.

Grayling’s proposals for environmental and planning judicial review

At first sight, proposals full of sound and fury, and signifying not a great deal for planning and environmental challenges. There are some slippery costs changes which we need to look at, but some of the potentially more concerning proposals (see Adam’s post and the linked posts) do not fully apply to this area, as I shall explain. There are also some perfectly sensible proposals about harmonising planning challenges which lawyers have been advocating for years.

This consultation got going in September 2013 when Grayling put forward his round 2 of reform to judicial review in a wide-ranging, and frankly worrying, consultation paper. This week’s announcement and draft bill seeks to take some of these measures forward, but leaves others at home.

Mercifully, the bill does not include the ill-thought out consultation proposal to reform rules about standing in judicial review – who can complain of unlawful action by government? The proposal had been very worrying to those concerned with environmental challenges. It would have led to the rather unsatisfactory position that a NIMBY complaining about a nearby development would have been able to challenge an unlawful decision, but an entirely altruistic concern about unlawfulness affecting, say, birds, bats or habitats would have been dismissed not on the merits, but because the NGO or individual conservationist had insufficient “interest” in the outcome. And then there were seven: Pinto-Duschinsky quitting Bill of Rights Commission

Updated | Dr Michael Pinto-Duschinsky has told the BBC’s Sunday Politics that he is resigning from the Commission on a Bill of Rights, effectively citing artistic differences. The seven other commissioners apparently wrote to the Justice Secretary stating Pinto-Duschinsky was “significantly impeding [the Commission’s] progress”. He has also written an article in the Daily Mail explaining why he quit (see my other post responding to that).

I argued last week that the Commission should open up more, but leaked internal emails were not exactly what I had in mind.

The resignation is hardly a surprise. Pinto-Duschinsky’s relationship with the other Commissioners has been rocky from the start, and he has been unabashed about complaining publicly when he has felt his views were being ignored. When the Commission published its initial consultation document he instantly told the Daily Mail that he ”strongly regret[ed] the terms in which it has been presented.” He was concerned that the document ignored the extent to which the European Convention had undermined Parliamentary Sovereignty. However strong Pinto-Duschinsky’s views, this public airing of Commission laundry must have made very difficult to hold reasoned debates behind closed doors.

Damages for death and human rights

Ms Swift lost her live-in partner in an accident at work caused by negligence. She was pregnant with her partner’s child, but had only been living with him for 6 months. Had she been with him for 2 years, she could have claimed damages for his death under section 1(3) of the Fatal Accidents Act – set out at [1] of the CA judgment. She would then have been a “dependant” as defined under the FAA. So she argued that her rights under Articles 8 (family) and 14 (discrimination) of the ECHR were not properly respected by the law governing damages for the death of a relative – there was no justification for this stark cut-off – 1 year 11 months no claim, 2 years a claim. The judge refused to grant a declaration of incompatibility between the ECHR and the Fatal Accidents Act, and the Court of Appeal has just upheld his decision.

A lot of money turned on the point:  Had she qualified as a dependant, she would have had a claim for about £400,000.

Church has employer’s duty of liability for parish priests

The Court of Appeal has now confirmed that the church can be held liable for the negligent acts of a priest it has appointed. Permission to appeal to the Supreme Court has been refused.

This appeal was another preliminary stage in the main action between the claimant’s action for damages following the alleged sexual abuse and assault by a parish priest (now deceased), and the trustees of the diocesan where he served. The Court of Appeal has now confirmed that the defendants can held to account, even though there was no formal employment relationship between Father Baldwin and the Diocesan – see Rachit Buch’s post for an excellent analysis of the issues and summary of the facts.

Two types of readers may be interested in this case; the first, who are interested in the age-old judging problem of whom to believe when faced with a conflict of evidence, and the second (and I don’t want to do any gender-stereotyping) those who are fascinated in whether a replica Porsche 917 (think Steve McQueen in Le Mans) over-revved and blew because (a) it had a gearbox fault or (b) the Defendant driver missed a gear.

I will disappoint the second set of readers – but the judgment is short and well-written, so, chaps, read it for yourselves  to find out why the gearbox was acquitted of all charges laid against it.

Fruit of the poisoned tree: evidence obtained under torture in the UK

Updated | A judge in New York has barred prosecutors of a suspected-terrorist from using the testimony of a man whose evidence may be tainted by CIA torture. What would happen if a similar scenario arose in the UK?

The New York Times reports that those prosecuting Ahmed Khalfan Ghailani in the first civilian trial of a man held at Guantanamo Bay have suffered a setback: “just as the trial was to begin on Wednesday, Judge Kaplan ruled that he would not allow [a man who was to testify that Ghailani sold weapons to him]  to testify. … the government had acknowledged that it had identified and located the witness through interrogation of Mr. Ghailani when he was earlier held in a secret overseas jail run by the Central Intelligence Agency. His lawyers have said he was tortured there.” The judge said:

Employment Tribunal provides reasoning in ethical veganism case

Casamitjana v The League Against Cruel Sports [2020] UKET 3331129/2018 

Following his headline-grabbing finding on 3rd January 2020 that “ethical veganism is a philosophical belief which qualifies as a protected belief within the meaning of section 10 of The Equality Act 2010”, Norwich Employment Tribunal Judge Postle has now provided his full determination.

Background

The judgment was handed down following a preliminary hearing in a matter between the Claimant, Mr Jordi Casamitjana Costa, and his former employer, The League Against Cruel Sports. The facts of the case are set out in more detail in an earlier article from earlier this month.

In short, the Claimant is pursing complaints, inter alia, of indirect discrimination, direct discrimination or harassment and victimisation by reference to his belief in “ethical veganism”. “Ethical veganism”, according to the Vegan Society,it is a philosophy and way of life which

seeks to exclude, as far as is possible and practicable, all forms of exploitation of, and cruelty to, animals for food, clothing or any other purpose.

GP’s rights not violated by suspension from performers list

The European Court of Human Rights held that the suspension of a GP from the Primary Care Trust (PCT) Performers List did not violate his right to peaceful enjoyment of possessions under Article 1 Protocol 1 (A1P1) of the European Convention on Human Rights. The Court declined to decide whether there was a possession that could be interfered with in this case, but held that suspension did not affect Dr Malik.

Dr Malik ran a general practice from premises he owned in London. He was under a general medical services contract with his PCT so that he had to ensure patients on his list were provided with GP services (whether by himself or a salaried doctor); his premises was rented (for a notional amount) so that it could be used for NHS services. Dr Malik was also on the PCT’s performers list so that he personally could provide GP services.

Extradition injustice remains despite European ruling in Radu – Alex Tinsley

The European Court of Justice’s Grand Chamber has ruled that the Charter of Fundamental Rights does not allow refusal to execute a European Arrest Warrant (EAW) on the basis that the person was not heard by the issuing authority.

With reform of the EAW at the centre of the debate concerning the UK’s big 2014 opt-out decision, all eyes were on the Court of Justice of the EU (CJEU) when it gave judgment in this case widely seen as an opportunity for it to address some key issues in the operation of the EAW system. There is some disappointment at the outcome.
