Freedom, Asylum Seekers, and Two Lots of European Human Rights – Michael Rhimes

European-Union-Flag_1C-601/15 JN (in French only) offers important insights into the detention of asylum seekers. It also somewhat of a double bill, involving not one but two sets of European Human Rights.

In this post I will set out the facts, give a quick refresher of the relationship between the European Convention on Human Rights (ECHR) and the Charter of Fundamental Rights of the European Union (Charter). I will conclude with an overview of the decision itself.

The decision contains a number of important elements, but the one I would like to focus on is the “fit” between the ECHR and the Charter. This manifests itself on two levels. The first is the abstract relationship between the ECHR and the Charter (see Marina Wheeler’s recent post on this: A Charter too Far). This is quite straightforward (see below). The more interesting part is the relation between the different ways the ECHR and the Charter protect from unlawful detention. As shall be seen, the former lists narrow criteria for the lawfulness of detention, whereas the second effectively provides a broad protection against unlawful detention. Reconciling the two was at the heart of JN.

Children in privately-run youth detention centres are being seriously injured whilst being restrained by staff, according to a redacted Ministry of Justice report released to the Director of the children’s rights charity Article 39. The report focuses on four secure training centres (STCs) and two young offender institutions (YOIs) – the worst three of which are all run by G4S.

The report lists ‘restraints-gone-wrong’, where children were injured or suffered breathing difficulties in the process. Rainsbrook SCT – where teenager Gareth Myatt died in 2004 after choking on his own vomit while being restrained – had the highest number of incidents of serious injury. One child vomited from a prolonged restraint whilst being held in a seated position similar to the one used on Myatt. Government guidelines classify vomiting during restraint as a medical emergency.

Carolyne Willow, Director of Article 39, has been engaged in legal proceedings against the MoJ for access to an unredacted version of the manual ‘Minimising and Managing Physical Restraint’, published in 2012, which details the restraint techniques used in STCs and YOIs. However, the Upper Tribunal recently dismissed her appeal in Willow v Information Commissioner & Ministry of Justice [2016], holding that disclosure of the information would threaten the good order and security of prisons, as inmates might develop countermeasures to the techniques. Willow had argued – unsuccessfully – that Article 3(1) of the UN Convention of the Rights of the Child required a greater emphasis to be placed on the child’s interests when balancing them against the public interest (see the Panopticon Blog for further analysis).

It came to light last week that Medway SCT – the subject of a BBC Panorama exposé aired in January this year which showed G4S staff appearing to use excessive force on children – is to be taken over by the Ministry of Justice. Four members of staff had been arrested on charges of child neglect in relation to the allegations, following which G4S announced in February it was selling off the contracts to run Medway, Oakhill SCT, and 13 local authority children’s homes.

Andrew Neilson of the Howard League for Penal Reform had called at the time for SCTs to be shut down completely, calling them a “failed model”. The Ministry of Justice is due to announce the findings of the Independent Improvement Board set up by Michael Gove in response to the Medway allegations, which will detail the future of the centre.

A wider review is currently being conducted into youth justice by Charlie Taylor, former head teacher and child behavioural expert, the final report of which is expected in July. The interim findings (available here) recommend an overhaul of the youth custodial estate, replacing youth prisons with smaller secure schools focusing on education.

Other news

  • In addition to the polling day problems in Barnet, it seems that thousands of women living in safe houses and refuges after fleeing domestic violence may have been disenfranchised. Mehala Osborne, a mother-of-one living in a refuge in Bristol, found it impossible to register anonymously as she could not adduce the required evidence to prove her safety would be at risk if her name and address appeared on the register. She estimates that 70% of women in refuges in Bristol and possibly across the country could be in the same situation. The evidence required for Anonymous Voter Registration is a court order or the attestation of an “authorised person” – a Police Superintendent, a Director of Adult Social Services, or the Director General of the Security Services or National Crime Agency. For many in Osborne’s situation, who have fled their homes quickly, there is no time to source such authorisation. The right to vote is protected by Article 3 Protocol 1 ECHR which states that the UK will “hold free elections … under conditions which will ensure the free expression of the opinion of the people in the choice of the legislature”. Osborne suggests that refuge and safe house management staff ought to be included in the definition of an “authorised person”.
  • Egyptian President Abdel-Fattah el-Sisi last week told a US delegation that human rights in Egypt should not be viewed from a “Western perspective”. Though reportedly keen to emphasise his commitment to democracy, he explained that “differences in domestic and regional conditions” make it difficult to apply the same standards. 237 human rights protestors were arrested last week during a peaceful demonstration in Cairo against the el-Sisi regime, including two journalists – Mahmoud al-Sakka and Amr Badr, who work for the opposition website Bawabet Yanayer – for “spreading false news and endangering national security”. Amnesty International have described el-Sisi’s remarks as “deeply troubling”, saying that “he should stop making excuses … There’s nothing remotely ‘Western’ about basic human rights like the right not to suffer torture or to be able to speak freely without fear of arrest or imprisonment”.
  • Arthur Scargill, the former miners’ union president, has called for an inquiry into the conduct of the South Yorkshire Police at the 1984 ‘Battle of Orgreave’. Thousands of minors clashed with the South Yorkshire police at the coking plant near Rotherham during the year long minors’ strike of 1984-5. A redacted version of the Independent Police Complaints Commission report into Orgreave was released last year, but the Yorkshire Post has now reported that the redacted sections proved the same senior police officers were involved in the aftermath of Orgreave as Hillsborough. Shadow Home Secretary Andy Burnham recently said that the full truth of policing at Hillsborough would not be known until there is transparency over Orgreave.
  • An Italian court has ruled that the theft of a piece of cheese and a wurstel sausage by a homeless man was not a crime because he acted in “desperate and immediate need of nourishment”. Roman Ostriakov had been sentenced by a lower court in Genoa to six months in jail and €100 fine after being arrested for slipping the sausage and cheese into his pocket when buying breadsticks in the supermarket. The Court of Cassation finally found in his favour, after a three-part trial to determine whether the theft of the food (worth about £3.70) amounted to a crime or not, prompting some commentators to lambaste the country’s notoriously inefficient legal system. Others, however, have lauded the judgment as establishing a “sacrosanct principle” that a small theft out of hunger is not comparable to an act of delinquency, and as an act of humanity which showed that in Italy the right to survive trumps property rights – something which would be “blasphemy in America”.

 

In the Courts

  • Cerf v Turkey  – The Court found a violation of the duty to conduct an effective investigation under the procedural aspect of Article 2 (right to life) into the suspicious death of the applicant’s husband. The applicant’s husband, Serf Cerf, a local politician, was shot outside a café in the town of Yüreğir in 1994 and died on the spot. In 2000, the authorities arrested a man (in the course of operations carried out against Hizbullah, an outlawed organisation in Turkey) who confessed to killing Mr Cerf. Despite criminal proceedings being initiated against him and four others in 2000, they were not concluded until 2009 and 2013. The Court considered the delays to be excessive and incompatible with the State’s obligation under Article 2, which requires proceedings to be initiated promptly and to proceed with reasonable expedition. The delays entailed the conclusion that the investigation had been ineffective.
  • Abdi Mahamud v Malta  – violations of Article 3 and 5. This case concerned a female Somalian asylum seeker detained for more than 16 months in overcrowded conditions, with little privacy and limited access to outdoor exercise. All the care of detained women was carried out by male staff. Ms Mahamud had been detained in May 2012. A decision on her asylum application was not made until December 2012 (when it was rejected). In the meantime she had been frequently hospitalised due several medical conditions. She was interviewed for release on the grounds of ill-health in December 2012, but was not actually released until September 2013. The cumulative effect of the detention conditions was found by the Court to be a violation of Article 3 (degrading treatment); a violation of Article 5 (right to liberty and security) § 1 was found in respect of the length of both periods of detention (seven months pending the asylum decision and the rest pending her removal). The lack of available measure to challenge the lawfulness of her detention was a violation of Article 5 § 4.

The UK can, and should, leave the Human Rights Convention: Shadow AG’s advice underlines Conservative Party’s policy

Update (10 October 2025): Kemi Badenoch has confirmed that Conservative Party policy will be to withdraw the UK from the European Convention on Human Rights (ECHR) and to repeal the Human Rights Act if they win the next general election. This was made clear in both her statements ahead of and during the annual Conservative Party Conference in October 2025, following a detailed legal review led by the Shadow Attorney General, Lord Wolfson, which found that remaining in the ECHR would fundamentally obstruct key party policies on immigration, veterans’ rights, prioritising citizens for public services, and reforming sentencing and protest laws. The Conservative Party leader explicitly stated in her conference speech: “We must leave the ECHR and repeal the Human Rights Act. The next Conservative manifesto will contain our commitment to leave. Leaving the Convention is a necessary step.”

Lord Wolfson’s advice was commissioned by the Conservative Party and is known as the Wolfson Report. It is important to note at the outset that, despite its title on the Party website, Lord Wolfson emphasises that this is “neither a policy paper nor a report. It is a legal analysis”, in other words, advice to the leader of the Conservative party. For reasons of economy in the following paragraphs I will refer to this 185 page document as a “report”.

David Wolfson KC is Shadow Attorney General Lord Wolfson of Tredegar, a prominent commercial lawyer and former justice minister. We have heard his views on the role of international law and his differences with government AG Richard Hermer domestic on Law Pod UK earlier this year.

In this paper he sets out an exhaustive examination of the relationship between the European Convention on Human Rights (ECHR) and UK law, specifically focusing on areas where the ECHR constrains the government’s ability to enact domestic policies. This report could be pivotal in shaping the party’s commitment to leave the ECHR, as it concludes that such a move is necessary to fulfil a range of key policy priorities.

For balance, here is the late Conor Gearty’s column in the London Review of Books Unwelcome Remnant – the threat to the Human Rights Act , lamenting judicial avoidance of ECHR solutions to problems and relying on common law or UK legislative measures instead. Gearty cites many examples of this, most notably the Supreme Court’s ruling in the For Women Scotland v The Scottish Ministers which he says “completely ignores the impact of human rights law.”

Back to Wolfson.

Overview

The report scrutinises the effect of the ECHR in five core public policy areas: immigration control, prosecution of military veterans, prioritisation of British citizens in social policy, sentencing and protest laws, and economic growth impediments (particularly linked to climate-based challenges to infrastructure projects). Wolfson sets out a detailed legal analysis and a set of evaluative “tests” for national sovereignty, arguing that only by exiting the ECHR and repealing the Human Rights Act can the UK achieve these policy goals unimpeded.

Top judge speaks! Are the judiciary becoming too outspoken?

Top Judge yesterday

A lot of headlines begin with “Top judge” at the moment. Top Judge has variously attacked MPs who reveal injunctions, expressed fears over cameras in court, warned legal aid in family cases may disappear, protested over legal aid reforms, urged murder law reforms and said Britain can ignore Europe on human rights (he didn’t, but that’s another story).

Aside from lazy sub-editors (one of whom was me), what is causing this proliferation of Top Judges? It may be that senior judges are speaking out more, even on controversial topics which could create problems for them in the future.

Or perhaps Top Judge has always been outspoken, but fewer people were listening. In the internet age judges’ pronouncements are more quickly and widely reported. Speeches are often published instantly (sometimes, even before being made) on websites such as judiciary.gov.uk. Previously obscure Parliamentary committee hearings are broadcast live on the internet. The increased profile of the still-new Supreme Court adds to this dynamic.

Grayling’s proposals for environmental and planning judicial review

At first sight, proposals full of sound and fury, and signifying not a great deal for planning and environmental challenges. There are some slippery costs changes which we need to look at, but some of the potentially more concerning proposals (see Adam’s post and the linked posts) do not fully apply to this area, as I shall explain. There are also some perfectly sensible proposals about harmonising planning challenges which lawyers have been advocating for years.

This consultation got going in September 2013 when Grayling put forward his round 2 of reform to judicial review in a wide-ranging, and frankly worrying, consultation paper. This week’s announcement and draft bill seeks to take some of these measures forward, but leaves others at home.

Mercifully, the bill does not include the ill-thought out consultation proposal to reform rules about standing in judicial review – who can complain of unlawful action by government? The proposal had been very worrying to those concerned with environmental challenges. It would have led to the rather unsatisfactory position that a NIMBY complaining about a nearby development would have been able to challenge an unlawful decision, but an entirely altruistic concern about unlawfulness affecting, say, birds, bats or habitats would have been dismissed not on the merits, but because the NGO or individual conservationist had insufficient “interest” in the outcome. Pssst… no secret hearings in naturalisation cases

Secrecy and secret justice are rarely out of the public eye. The Queen’s speech included plans to allow secret hearings in civil claims, at a time when their use is highly controversial. The government argues they are necessary to safeguard national security. Civil liberties groups and even the Special Advocates who help administer them, regard them as a bar to real justice and fair hearings.

So it seems appropriate at this time that the High Court has handed down an important decision on the use of Closed Material Procedures (CMP) in Judicial Review claims relating to naturalisation (the process by which foreigners can be ‘naturalised’ as British citizens). In simple terms, this is a variety of procedure where the government can rely on evidence which it has not disclosed to the opposing party, in a closed hearing. In the closed proceedings, the Claimants are represented by Special Advocates, who are subject to strict rules relating to what they can and cannot tell their clients.

Analysis – Daily Mirror and The Sun in contempt over Jo Yeates murder case

The High Court has found that the Daily Mirror and The Sun were in breach of the Contempt of Court Act 1981 (1981 Act) in relation to their reporting of the Jo Yeates murder case. The court was strongly critical of the “vilification” of a man who was arrested but quickly released without charge.

The proceedings were in relation to Christopher Jefferies, a school teacher who was arrested early on in the investigation. The court fined the Daily Mirror £50,000 and The Sun £18,000.

The Court of Appeal has published its decision in Guardian News Media v AB and CD. It is not a judgment, the Court says. Judgments – plural – will be given “in due course.” Still, the 24 paragraph decision contains the order and explanation of the order, and gives an indication of some of the reasons that will follow.

Is this a good decision? It is better than it might have been, but there are still deeply worrying problems.

Privacy and the media

Last week Lord Judge LCJ gave a speech on “press regulation” at Justice’s Annual Human Rights Law Conference.

His speech was an unusual one, given that judges generally refrain from commenting on the important issues of the moment. Lord Judge was supportive of Lord Justice Leveson and of the Press Complaints Commission, both targets of criticism in the context of the inquiry into the culture, practices and ethics of the press and the Leveson inquiry.

Analysis: Occupy London loses final eviction court challenge

Members of the Occupy London Movement who have been occupying an area close to St Paul’s Cathedral have had their applications for  permission to appeal the decision of the lower court to evict them refused by the Court of Appeal.  The judgment of Mr Justice Lindbolm was deemed ‘very full and careful’by the Master of the Rolls.  Shortly after midnight yesterday police began evicting occupants at the site.

In January we reported on the High Court battle between the City of London and the Occupy London Movement who had been occupying an area close to St Paul’s Cathedral. Mr Justice Lindbolm’s well-reasoned decision to grant possession, interlocutory and declaratory relief to the Mayor Commonality and Citizens of London meant that the Occupy Movement were to be evicted.

An open or shut case?

R(C) v. Secretary of State for Justice [2016] UKSC 2 – read judgment.

When is it right to keep the names of parties to litigation a secret? That was the difficult question the Supreme Court had to grapple with in this judgment, handed down on Wednesday. The decision to allow a double-murderer to remain anonymous led to outraged headlines in the tabloids. Yet the Court reached the unanimous conclusion that this was the right approach. Why?

The Facts

C, who had a long history of severe mental illness, was convicted of murdering his ex-girlfriend and her new partner in 1998 and sentenced to life imprisonment with a minimum term of 11 years before parole could be considered. The murder was described by Lady Hale as “a particularly savage killing which must have caused untold suffering to the victims and has continued to cause great grief to their families.” During his sentence C was transferred from prison to a high security psychiatric hospital. Whilst there, in 2012, C’s treating doctors applied for permission to allow him unescorted leave in the community in order to assess how well his treatment was progressing and whether he would be suitable for discharge. The Secretary of State refused to allow this.

The Weekly Round-up: Crown courts and protest rights under strain

Figures published by the Ministry of Justice showed that the backlog of crown court cases had risen to yet another record high: by 31 March this year, there were almost 60,000 outstanding cases, a rise of 45 per cent on the previous year. In the magistrates’ courts, that figure stood at 400,000, a rise of 21 per cent.

Waiting times have hiked accordingly: the average crown court case it now taking just under a year, 363 days, to be heard. Some trials are already being scheduled for 2023.

These latest figures follow the Ministry of Justice’s End-to-End Rape Review Report on Findings and Actions, covered on last week’s round-up, which revealed that processing times for rape complainants were particularly egregious, averaging around a thousand days between the commission of an offence and the conclusion of a trial.

Several MPs were quick to diagnose root causes of the criminal justice system’s dismal condition. Shadow justice secretary David Lammy complained that ‘the Conservatives are forcing victims of rape, domestic abuse and violent assault to wait months and years for justice if they get it at all’, blaming the compounded effect of ‘the government’s decade of court closures, combined with its incompetent response to the pandemic’. Liberal Democrat MP Wera Hobhouse also pointed to pre-coronavirus underfunding, warning that ‘ministers must not use Covid as an excuse for this backlog, or to undermine the fundamental right to trial by jury.’
