Condliff, R (on the application of) v North Staffordshire Primary Care Trust [2011] EWCA Civ 910 – Read judgment
A morbidly obese man has lost his appeal against his local Primary Care Trust’s (PCT’s) refusal to fund his anti-obesity surgery. The Court of Appeal ruled that the PCT had no obligation under Article 8 of the European Convention on Human Rights to consider social or non-clinical factors when deciding whether to grant a request for exceptional funding.
In his discussion of the case, Lord Justice Toulson began by saying that “Human rights law is sometimes in danger of becoming over complicated“. Underlying this point is the fact that it is already complicated enough. This is a good example: how could a court find that this case, which clearly involves the dignity and family life of a man whose life is difficult and miserable, not engage the protection of human rights law? I will try to explain.
The UK Home Office has begun a ten-week public consultation into the use of facial recognition and biometrics technologies by the police, with the view to expanding the rollout of live facial recognition policing (currently limited to ten forces) across the entire UK. Among the Government’s proposals is the creation of a regulator overseeing police implementation of the technology; any new legislation arising from the consultation is unlikely to be in force for at least another two years. The Government has invested over £15 million into facial recognition policing since 2024. Its currently unregulated use has drawn sharp criticism from human rights and civil liberties groups, and in August the Equality and Human Rights Commission warned that its present implementation was disproportionate in its infringement of human rights. Liberty director Akiko Hart responded positively to this week’s announcement of a consultation, but stressed that the Government “must halt the rapid rollout” of facial recognition and ensure that rights-prioritising safeguards are in place. Big Brother Watch director Silkie Carlo called the “consultation necessary but long overdue”, adding that police facial recognition should be paused immediately, pending the consultation’s outcome. Strong tendencies towards racial discrimination in the use of the technology have raised particular concerns, as the Home Office conceded this week: whereas white people are only wrongly identified by the technology at a rate of 0.04%, this occurs at a rate of 5.5% for black people and 4% for Asian people. Earlier this year the Metropolitan Police declined to adopt live facial recognition at September’s far-right ‘Unite the Kingdom’ rally, despite deploying it weeks earlier at the Notting Hill Carnival.

With the continuing progress of the Marriage (Same Sex Couples) Bill through Parliament, focus was turned this week to the same issue in the USA. Meanwhile, it was extra-judicial scrutiny being meted upon Chris Grayling’s money-making proposals, and the Sun was censured by the PCC over an EU-ECtHR mix-up.
The Human Rights Act applies in the UK. That much is clear. Whether it applies outside of UK territory is a whole other question, and one for which we may have a new answer when the Grand Chamber of the European Court of Human Rights gives judgment in the case of Al-Skeini and others v. the United Kingdom & Al-Jedda v. the United Kingdom next week.
The court is to give its long-awaited ruling at 10am (Strasbourg time) on Thursday 7 July. In short, the 7 applicants in the case were killed, allegedly killed or detained (Al-Jedda) by British forces in Iraq between 2003 and 2007. Both of the claims reached the House of Lords in the UK (now the Supreme Court), and in all but one case, which involved a death in a military detention centre, the court found that the Human Rights Act did not apply in Basra at the time, and therefore the UK military had no obligation to observe the requirements under the European Convention on Human Rights, and in particular article 2 (the right to life) and article 5 (right to liberty).
The Coalition Government is only a few days old but it is already receiving a cautious welcome from civil liberties commentators and bloggers, with all eyes on significant policy commitments in the Con-Lib deal. The previous government enacted major civil liberties legislation within a year of taking power; the question now is whether the Coalition has the time, will and co-operative potential to fulfil its lofty promises.
In its final years, New Labour was regularly criticised on civil liberties issues, particularly in relation to anti-terrorism law. But it is undeniable that within around a year of coming to power it had enacted a major piece of civil liberties legislation in the Human Rights Act 1998, which was followed shortly after by two others; the Data Protection Act 1998 and Freedom of Information Act 2000. Some, such as the Human Rights in Ireland Blog, say that sadly this was a high water mark and not to be repeated.
The Con-Lib coalition has already made significant early promises. The focus of commentators has been on the cabinet appointees who will influence law and order policy, as well as the surprisingly full civil liberties section in the Con-Lib Coalition agreement. Just as important, however, is what has been left out.
Public Interest Environmental Litigation and the European Court of Human Rights: No love at first sight, by Riccardo Pavoni – read article
Thanks to this link on the ECHR blog, a fascinating account of the twists and turns of Strasbourg environmental case law from Professor Pavoni, of the University of Siena. It is 30 closely-argued pages, so I shall try and give a flavour of the debates Pavoni covers, as well as chucking in my own penn’orth.
The starting point, as I see it, is that public interest environmental litigation is a square peg in the round hole of Strasbourg case law. The Convention and the case law are concerned with victims of human rights abuses. Environmental degradation affects everyone, but not necessarily in a way which makes them a a Strasbourg victim. Take loss of biodiversity, say the decline in UK songbirds, or the peace of a remote moorland affected by 150m high wind turbines. Who is the potential victim in those cases when judged by human rights? Pavoni argues that if the Strasbourg Court were to assert jurisdiction over environmental cases as a common good, alongside adverse impacts on private victims, this would not result in a major overhaul of the Court’s current principles – not too much expansion of the hole needed to fit the square peg in snugly. How does he reach that position?
Case C-396/11 Radu [2013] ECR I-0000 – Read judgment
The European Court of Justice’s Grand Chamber has ruled that the Charter of Fundamental Rights does not allow refusal to execute a European Arrest Warrant (EAW) on the basis that the person was not heard by the issuing authority.
With reform of the EAW at the centre of the debate concerning the UK’s big 2014 opt-out decision, all eyes were on the Court of Justice of the EU (CJEU) when it gave judgment in this case widely seen as an opportunity for it to address some key issues in the operation of the EAW system. There is some disappointment at the outcome.

Wilton Park
The report from the Wilton Park conference, where the good and great of Europe met to discuss the future of the European Court of Human Rights, has been published. Suggestions included requiring individuals to show that non-examination of the case would cause a “significant disadvantage” and introducing a “universal periodic review” procedure, such as that used by the UN. It was recognised that national implementation was by far the biggest challenge that the system faced. The full report can be found here.

Commentary on the Eweida Christian cross case continued to dominate legal commentary this week, some of it critical of the European Court of Human Rights. Bloggers have also welcomed the go-live of the Supreme Court’s online archive of judgment summaries. Some interesting cases in the courts this week this week relating to attempts to use the European Convention on Human Rights in a housing dispute, as well as (in a similar vein) a local council’s ability to withhold details of vacant properties from potential squatters. Keep an eye out next week for the publication of the Mid-Staffordshire NHS Trust Public Inquiry on 5th February.

Coman and others, Case C‑673/16, 5 June 2018 – read judgment
Can the term “spouse” in Article 2(2)(a) of the Citizenship Directive (Directive) refer to a spouse of the same sex as the other party to the marriage (same-sex spouse)?
This (fairly dry) question was at the heart of the Comancase. Of course, as the Advocate General recognised in his Opinion, para. 2 it touched on other (more juicy) questions of dignity and the diverging understandings of marriage in the 28 Member States.
In this post I will present the facts and reasoning in the judgment. My following post will offer three comments on it.

Mr Coman, a dual national of Romania and the US, met Mr Clabourn Hamilton, a US national, in New York in 2002. They married in Brussels (Belgium) in 2010. In 2012, Mr Clabourn Hamilton asked the Romanian authorities to provide him with the documents to allow him to stay in Romania, with Mr Coman, as his spouse, for longer than three months.
Updated | In the 1939 film Mr. Smith Goes to Washington, James Stewart plays a local Boy Rangers leader who becomes a US Senator and, against all odds, triumphs agains the corrupt bureaucrats in Washington. Tomorrow, according to The Sun, “battling” Prime Minister David Cameron will be travelling to Strasbourg in, it would seem, similar style to “tell Euro judges to stop meddling in British justice”.
Meanwhile, back in London, the British president of the European Court of Human Rights launched a preemptive strike on Mr Cameron’s speech in today’s Independent, arguing that the criticism from “senior British politicians” relating to the court’s interference is “simply not borne out by the facts“.

The Supreme Court’s ‘terrible twos’?
The Supreme Court has become a toddler, celebrating its second birthday last week. The Guardian has produced a video interview with the justices as well as an article with some of the Justices who attempt to demystify the Courts’ processes. But will its birthday mark the beginning of the court’s ‘terrible- twos’?
Lady Hale, the only female Justice, has certainly been vocal of late. Calling for more diversity amongst the judiciary, Hale argues that we need to “think of the very able people that are doing … less visible forms of practice, rather than just thinking about the top QCs”; representing a possible contrast to the other male Justices who argue that promoting diversity over merit would be a “great mistake”.
Its characterisation as an opt out or a mere “clarification” depends on where one stands on the eurosceptic/europhile spectrum. So where do we find a practical rather than an ideological answer to this important question? Certainly not in the political or academic record.
First, a reminder of what the Charter is all about. From the very early days of the European Community the Court of Justice (ECJ) has relied on fundamental principles of human rights as an interpretative tool, and the key provisions of the Charter are derived from the ECHR, which is uncontroversial enough. However a large number are drawn from the Community Social Charter 1989 and the Council of Europe’s Social Charter 1961. These are the so-called “social and economic rights” which appear to transform aspirational norms into judicially enforceable ones, like the right to work or healthcare. These “rights” are largely to be found in the “Solidarity Title” of the Charter, and it is to this part of the Treaty that the UK secured an opt out at the European Council in 2007.
