The European Court of Human Rights has declared that a decision in the cases of two Iraqi murder suspects in UK custody in Iraq is now final and will not be reconsidered. The court has effectively prohibited the death penalty under the European Convention on Human Rights, despite Article 2 (the right to life) appearing to expressly allow it.
The judgment is an important restatement of the prohibition against the death penalty which has been agreed to by all Council of Europe states. However, the reasoning of the court in prohibiting it under the European Convention, founded on the men’s “mental suffering caused by the fear of execution amounting to inhuman treatment”, rather than a prohibition against states carrying out the death penalty itself, may generate difficulties in future cases relating to inhuman and degrading treatment.
I attended a talk this morning given by Igor Sutyagin, a nuclear scientist who was detained for 11 years on charges of treason. He was released in July as part of the high-profile spy-swap with the United States.
Hearing Sutyagin’s description of the Russian justice system, as well as the “gulag” he was sent to for over a decade, brings into focus the enormous difference between legal systems within Europe. In the UK we can confidently expect that courts and judges will uphold the rule of law and act with impartiality. Whilst there are notable exceptions, our legal system has checks and balances in order that poor decisions can be weeded out. That system is imperfect but at least it is predictable and, on the whole, fair.
Updated British Foreign Policy will put more emphasis on protecting human rights, the Foreign Secretary said in a speech today at Lincoln’s Inn.
It has been widely reported this morning that Mr Hague will argue that a focus on human rights is inextricably linked to the UK’s security and standing, and in the context of the upcoming torture inquiry, “directly linked to the belief of others that we will do what we say and we will not apply double standards“.

In the case of Dink v. Turkey the European Court of Human Rights concluded that the authorities failed in their duty to protect the life and freedom of expression of the journalist Firat (Hrant) Dink, a prominent member of the Armenian minority in Turkey who was murdered in 2007.
Dink was a Turkish journalist of Armenian origin, and the publication director and editor-in-chief of Agos, a Turkish-Armenian weekly newspaper.
Updated, 3 Sep, 16:35 | The Home Office is to announce a review of UK extradition agreements with other countries, including the controversial and some say unbalanced agreement with the United States. This represents a provisional success for campaigners against certain extradition agreements.
According to reports, the review will include the Extradition Act 2003 which implemented into law the UK-United States extradition treaty. It will also consider the European Arrest Warrant, which was used for 50% more arrests last year. The review fulfils the pledge made in the coalition’s program for government to ”review the operation of the Extradition Act – and the US/UK extradition treaty – to make sure it is even-handed”.

Last month, Matt Hill posted on a case relating to the retention of DNA profiles and fingerprints by the police, for which the full judgment is finally available. Permission has been granted for an appeal directly to the Supreme Court, and the outcome of that appeal may have interesting implications for the status of European Court of Human Rights decisions in domestic law.
It is worth revisiting the decision in order to extract some of the principles, as although not novel, they do highlight the difficulties for claimants who have taken a case to the European Court of Human Rights and won, but who are still waiting for their decision to be implemented by the UK government.
The Foreign Secretary William Hague has sought in today’s Daily Telegraph to re-emphasise the “centrality of human rights in the core values” of UK foreign policy. On the face of it, this is a laudable aim. But does it really mean anything? And may it in fact amount to an unrealisable promise?
The editorial evokes Mr Hague’s early commitment to put human rights at the “irreducible core” of UK foreign policy. This pledge has been questioned recently due to the potential reduction in scope of the Foreign Office’s annual human rights report. Mr Hague addresses this directly, although with little new detail:
In a fascinating new essay, Samuel Moyn, a history professor at Columbia University, examines the history of human rights. He concentrates on the concept of international human rights from a U.S. perspective, but many of his observations are highly relevant to those with an interest in UK human rights. As is often the case, examining the movement’s history provides interesting clues as to its future.
Moyn begins by recalling US President Jimmy Carter’s 1977 inaugural speech, when he said that “Because we are free we can never be indifferent to the fate of freedom elsewhere... Our commitment to human rights must be absolute.” Our own Foreign Secretary made a similar commitment after the May 2010 election. But whereas now the concept is well known, in 1977, Moyn says, many people had never heard of “human rights”, and no previous president had mentioned the concept in any substantive way. Interestingly, the current US president Barak Obama has barely mentioned human rights during his time in office, and this may well be a reaction to his predecessor George Bush’s invocation of human rights to justify the invasion of Iraq.
Review: The Ripple Effect: Guantanamo Bay in the United Kingdom Courts” by CRG Murray, International Law Review Online Companion, April 2010 – Read article
A new academic article by C.R.G Murray at Newcastle University analyses the interesting and important line of case-law arising from claims by men detained in Guantanamo Bay. The case-law has involved many issues of a politically sensitive nature and generated much media coverage and pressure on the British Government. The ripple effects from the detentions have led to a series of important judgments.
Murray’s article reviews important case-law arising from detention at Guantanamo Bay and the impact it has had on the decisions reached by the courts. Murray concludes that the case-law demonstrates two major ‘ripple effects’: (1) judicial review has been used to press the British Government into being more active in opposing detentions at Guantanamo Bay; (2) where serious human rights breaches are in issue, the courts have been more willing to disregard historic concepts of comity between courts in different jurisdictions and give their own view of the correct interpretation of law for the benefit of appellate courts in the United States.
It is possible that the European Union will soon sign up to the European Convention on Human Rights. The change would have interesting implications for European human rights law, as well as for UK citizens seeking redress for alleged human rights violations.

It may sound odd that whilst member states are signed up to the European Convention, the European Union as a corporate body is not. But negotiations began last month (see this Council of Europe press release) on the European Union’s accession to the European Convention. The Vice-President of the EU’s Commissioner for Justice, Fundamental Rights and Citizenship said “We are now putting in place the missing link in Europe’s system of fundamental rights protection, guaranteeing coherence between the approaches of the Council of Europe and the European Union”.
A new Government report on the implementation of European Court of Human Rights judgments has highlighted the vexed issue of the rightful place of such rulings in domestic law. Many decisions, for example on prisoner voting rights, have languished unimplemented for years and it remains to be seen whether the Coalition Government will do any more to fulfil its legal obligations to the thousands affected.
The report sets out the Government’s position on the implementation of human rights judgments from the domestic and European courts. It is a response to the Joint Committee on Human Rights‘ March 2010 report, in which the committee criticised “inexcusable” delays in implementation.
The United Kingdom is obliged to implement judgments of the European Court of Human Rights under Article 46 of the European Convention on Human Rights. In 2009, the UK was found to have violated the European Convention 14 times, which represents 1% of the overall total of violations found by the Court. However, the UK has a high proportion of leading cases outstanding for more than 5 years.
A Federal court in California has struck down a ban on gay marriage in the state, marking the first step on a path to a United States Supreme Court decision on the issue. A similar decision is unlikely here, however, given a recent European Court of Human Rights ruling on gay marriage. Ultimately, only Parliament is likely to bring about a change to the law in the UK.
